Compromise Agreement Datasheet
Overview
The Compromise Agreement is suitable for when an employee’s employment is terminated and the employer wants the employee to give up any rights they may have to any employment related claims. In return for the employee giving up their rights, the employer normally has to pay the employee some compensation.The Agreement sets out the clauses about the compensation and the giving up of rights.
The law requires that before an employee signs a Compromise Agreement, they must have received advice about it from one of: a qualified Lawyer, qualified Trade Union official or a qualified advice centre worker.

Features of the Compromise Agreement
Suitable for senior or junior employees whose contracts have been or are about to be terminated.
Claims that are commonly compromised include:

- Unfair dismissal
- Illegal discrimination of all types
- Redundancy payments
- Working Time regulations
- Maternity related claims
- Equal pay claims
The agreement must relate to particular proceedings that are being settled, or to a particular claim. Many employers attempt to compromise all claims (even where none my be threatened). This is not without risk as it may be found to be void.
